Disconnections
PAYMENT REQUIREMENTS AND SERVICE SHUT OFF
Different utilities have different billing
dates. You should be aware when a bill is due, when it is considered
delinquent and when you can expect your service to be shut off for
nonpayment. (410.10(a-d))
You have 20 days from the date of rendition of a bill for a payment
in full. (410.13(a)) If you do not pay it within 20 days, you will be
sent a notice stating you have 15 days in which to pay your past due
bill. (Delinquency Notice). (410.13(b)) This notice will contain
information about your rights in regard to disconnection procedures.
(410.29) If you do not pay or make other arrangements, the utility must
then give you 2 days advance notice before shutting off your service.

If you are unable to pay your bill, please contact the utility before
receiving a delinquency notice or before service is disconnected. It may
be possible to discuss payment arrangements.
When a payment plan has been agreed to and upon receipt of a payment,
restoration of service will be made no later than the next working day.
If service has been shut off you will be charged a reconnect fee.
WHEN
YOUR SERVICE CAN BE SHUT OFF
Tampering With or Damaging Equipment
Your service can be discontinued
without notice if you:
- tamper with or damage or deliberately destroy equipment that
is furnished by the utility,
- make unauthorized use of service, or
- use the service in a manner that is injurious to the service
provided to others. (410.29(a))
Temporary Interruptions of Service
Your service can be temporarily interrupted
without notice for maintenance of equipment or
if a state of emergency exists. Your service will be interrupted should
the utility discover hazardous conditions that require disconnection for
safety reasons.
Failure to Pay Bills
Your service can be shut off with prior notice if you do not:
- pay your bill,
- pay a required deposit, or
- comply with the terms and conditions of a settlement
agreement. (410.29(b))
Other Reasons
Your service can be shut off with
3 days notice if you do not:
- grant access at reasonable time to the utility's equipment
on your property for inspection, meter reading, maintenance or
replacement,
- give the utility necessary service, equipment, permits,
certificates and/or rights-of-way necessary to give you service
or the same are withdrawn or terminated,
- comply with the Rules and Regulations of the utility on file
with the NMPRC, or
- fulfill contractual obligations for service and/or
facilities other than settlement agreements. (410.29(c))
